The RA APPEALS OFFICE ADMINISTRATOR is a member of the RA JACKSONVILLE APPEALS team of the Division of WORKFORCE SERVICES. The Appeals Office Administrator supervises the operation of a district appeals office which includes directing a staff of Special Deputies. Ensures that appealed reemployment assistance (RA) cases are scheduled, hearings conducted, and decisions rendered by subordinate staff. Required to have supervisory skills as well as the skills of an Administrative Hearing Officer pursuant to Chapter 120, Florida Statutes. Directly responsible for training and evaluating Special Deputies and Deputy Clerk Supervisor and effecting or recommending all personnel related matters relating to subordinates. The incumbent of this position is required to travel and must provide own transportation. THIS POSITION HAS THE FOLLOWING MINIMUM KNOWLEDGE, SKILLS, AND ABILITIES --- Knowledge of Reemployment Assistance law and rules, court rules, applicable court cases, principles and techniques of effective verbal and written communication.--- Skill at legal research and conducting administrative hearings.--- Ability to: manage employees and office programs, evaluate workload and staff performance, train on legal issues, appeal decision preparation and the conduct of an appeals hearing. THE HIRED CANDIDATE WILL BE RESPONSIBLE FOR THE FOLLOWING --- Supervisory employees are those who spend the majority of their time*communicating with, motivating, training, and evaluating employees, and planning and directing employees work, and who have the authority to hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward, or discipline subordinate employees or effectively recommend such action, including all employees serving as supervisors, administrators, and directors. Section 110.205(2)(w), Florida Statutes.--- SUPERVISORY AND MANAGEMENT DUTIES: The Appeals Office Administrator ensures that reemployment assistance appeals assigned to the office are properly scheduled, heard, and the decision rendered, and the parties to proceedings are granted all procedural and due process rights as required by Chapter 120, Florida Statutes; Chapter 443, Florida Statutes; Chapter 38-B and 38E-5, Florida Administrative Code; The Florida Evidence Code; and Federal Performance Criteria. Directly responsible for providing initial training to new Special Deputies and ongoing training to all Special Deputies. Assigns the caseload and monitors the cases to ensure timely and accurate completion. Responsible for making recommendations regarding the staffing, physical facilities, and all personnel related activities for subordinate staff. Responsible for monitoring the work of the Deputy Clerk Supervisor to ensure that notices of hearings and decisions are promptly and accurately typed and mailed to parties. Interacts with the public and is directly responsible for resolving any public complaints concerning subordinate staff. Interprets policies, procedures, and laws to associates, subordinates, employers, attorneys, employees, claimants, and the general public. Must maintain regular communication with the RA Appeals Manager concerning routine office operations and communication with peers in other offices of the Department concerning local operations. Responsible for making regular and special reports as required to the RA Appeals Manager and Central Office on a timely basis. Section 110.205(2)(w), Florida Statutes.--- APPEALS HEARING ACTIVITIES: The hearings are conducted at established locations within the geographic area served by the appeals office and may be conducted in-person, by telephone or a combination thereof. The hearings are formal evidentiary hearings conducted pursuant to Section 120.57, Florida Statutes. Among other things, the incumbent is required to: take all evidence under oath or affirmation, determine the order of testimony, control disruptive parties, rule on objectives to evidence, and rule on all oral or written motions filed with the Appeals Office Administrator during the hearing. Regardless of whether a party is represented by counsel or duly authorized agent, the incumbent is responsible for ensuring that a complete record is made of the facts and circumstances surrounding the issues involved. Responsible for ruling on claimant's representative's request for a fee for representation at the hearing.--- PREHEARING AND SCHEDULING ACTIVITIES: The Appeals Office Administrator may be required to review the case file and determine the issue involved and set the date, time, and location for the hearing. Responsible for ensuring that the documents in the file are complete. Must rule on all pre-hearing motions, such as: motions to effect discovery, motion to issue or quash subpoenas, motion for continuance, and any other pre-hearing motion filed by a party.--- DECISION WRITING ACTIVITIES: Decisions written by the Appeals Office Administrator must use proper grammar, punctuation, and sentence and format structure. The decision must be processed in a timely manner to meet federal time lapse standards. In formulating the decision, the Appeals Office Administrator must analyze the evidence entered into the record at the hearing. The Findings of Fact as set forth in the decision are binding, on appeal, if the findings are based upon competent, substantial evidence in the record. In analyzing the evidence, the incumbent must rule on the competency of the evidence, the sufficiency of the evidence, resolve disputed issues of material fact, and ensure that all the relevant findings on the issue are included. Must also accept or reject proposed Findings of Fact submitted by a party pursuant to Chapter 120, Florida Statute. The incumbent is required to analyze the facts according to the statutory provision on appeal and any applicable Florida Administrative Code Rules and apply interpretations issued by administrative and appellate reviewing authorities (Reemployment Assistance Appeals Commissions and all appellate courts). If a brief is filed by a party, the incumbent must either accept or reject the case citations therein and, if rejected, must specifically set forth the rationale for rejection. If the incumbent is presented with a disputed issue of material fact, the decision must specifically set forth the dispute and the rationale by which it was resolved. --- The ultimate decision sets forth the administrative action which the Department must take. By statute, party(s) or the Department of Economic Opportunity may file an appeal to a decision by the Appeals Office Administrator.--- Performs other related duties as required. OTHER REQUIREMENTS THAT MAY BE REQUIRED FOR THE POSITION --- A Juris Doctorate from a law school accredited by the American Bar Association and admission to the Florida Bar.
