POSITION SUMMARY:
This position holds significant responsibility and manages
Citizens' In-House Litigation Unit. This position will manage
complex and high exposure cases through trial and supervise
litigation counsel handling cases of lesser complexity or exposure.
The position will implement Citizens' litigation strategies at the
direction of the Office of the General Counsel and the Claims Legal
Counsel department.
ESSENTIAL FUNCTIONS:
Responsible for the overall management, efficiency, and
effectiveness of Citizens' In-House Litigation Unit.
Managing staff including litigation counsel, paralegals and legal
assistants including hiring, goal setting, and completion of
performance evaluations.
Training, mentoring, and directing litigation counsel engaged in
litigation first-party property claim litigation.
Assigning cases to attorneys and teams and otherwise delegating
tasks.
Represent Citizens in all aspects of complex, strategic or high
exposure first party property claim litigation and other
alternative dispute processes. Duties and functions will
include:
Review and analysis of evidence.
Review, analyze and draft pleadings and motions.
Manage all deadlines and advise Claims Litigation of such
deadlines.
Prepare all required and appropriate reports and evaluations for
Claims Litigation.
Communicate with in house Claims Legal Counsel and Claims
Litigation in coordinating strategies.
Review, analyze and respond to discovery requests and prepare
discovery requests.
Prepare witnesses for depositions and attend and conduct witness
depositions.
Legal research and preparation of legal memoranda.
Attend mediations.
Attend and argue motions and make other court appearances as
required.
Prepare for trial or final hearing in dispute resolution forums
other.
Function as first or second chair attorney representing Citizens in
trials or final hearings.
Engage in settlement negotiations in the direction of Claims
Litigation.
Attend and argue post-trial motions including motions seeking
attorney's fees and costs.
Additional functions:
Collaborates with others in the Office of the General Counsel and
Claims Legal Counsel.
Collaborates with General Counsel, Claims Legal Counsel and Claims
Litigation on the development of litigation strategies.
Performs other legal services and special projects as directed by
the General Counsel.
Qualifications REQUIRED KNOWLEDGE, SKILLS, AND ABILITIES:
Comprehensive knowledge of Florida litigation practices and
procedures.
Current deep knowledge of the insurance regulatory environment.
Strong knowledge of relevant laws, amendments, and their
interpretation.
Advanced legal knowledge of regulatory agencies and insurance
industry.
Skilled in legal analysis, critical thinking, legal counseling, and
problem solving; creativity in resolving unique and challenging
business problems; good legal and business judgment.
Ability to effectively interact with internal and external business
partners, attorneys, and Senior Management.
Ability to lead, coach, motivate and promote employee
engagement.
Excellent communication (written and verbal), interpersonal and
presentation skills.
Must be proactive and responsive in fast paced environment, in a
highly regulated environment.
Ability to work autonomously and as part of team (legal and
project), to lead, follow, and collaborate.
Track record of building and leveraging strong relationships
internally and externally, resulting in successful implementation
of strategic priorities, operational improvements, and corporate
objectives.
Demonstrated ability to assess risk, evaluate liability and damage
exposures, propose, and implement litigation management strategies,
as well as strong negotiation skills.
Ability to organize, lead and coordinate complex project(s)
Forward-thinking and creative, with the confidence to present and
advocate for the implementation of ideas.
Ability to initiate, organize, prioritize, and coordinate complex
projects and cases.
Powerful sense of urgency, personal responsibility, and
accountability; self-motivated, efficient, and effective.
Strong discovery skills - particularly record production and
witness preparation.
REQUIRED EDUCATION AND EXPERIENCE:
Bachelor's Degree OR 4 years relevant experience, OR a combination
of college education and relevant experience equivalent to 4
years
J.D. required Admitted to Florida Bar and in "good standing"
AND
10 or more years of litigation and trial experience.
Experience in all facets of the litigation process from inception
through trial or settlement.
5 or more years managing/leading attorneys.
PREFERRED QUALIFICATIONS:
12 or more years of litigation experience.
Three or more years of Florida homeowners and commercial property
insurance experience.
Strong academic record.
PHYSICAL REQUIREMENTS:
This position requires the ability to sit for long periods of time,
hear and converse over the telephone and key frequently on a
computer (4 or more hours per day).
